The Law Research Of Energy Cooperation Of Sino-Russia

As a principal element for the development of the economy, energy sources havebeen attached with great importance. China is one of the largest energy consumers in theworld. With the rapid development of economy, the import demands of energy areincreasing. Participating in the international energy cooperation will certainly becomeone option for China’s energy strategy. In recent years, the friendly cooperativerelationship between China and Russia has been reinforced continuously. To cooperatewith Russia which reserves abundant energy sources will be the interest of bothcountries.The Sino-Russian energy cooperation’s development is based upon the series ofdocuments between the governments of China and Russia or agreements amongcorporations. The energy cooperation is the big issue in the level of economiccooperation between those two countries. The legal system is the important pillar ofeconomic activity, which can assure the stability of the economic order. Therefore, thelegal system that is referred to the Sino-Russian energy cooperation should also beattached great importance to by both of the countries.This thesis consists of four parts. The first part is the overview of current situationof the Sino-Russian energy cooperation. It briefly introduces the major content of theSino-Russian energy cooperation, and then demonstrates the actuality of the cooperationspecifically from the perspective of energy field and reviews the cooperation actualityas well. Meanwhile, it analyzes the effects and impacts the framework of ShanghaiCooperation Organization has on the Sino-Russian energy cooperation.The second part deals with the legal basis and defects of the laws and regulationsrelated to the Sino-Russian energy cooperation. In this section, it respectively introducesthe multilateral treaties and bilateral treaties the two countries have established orconcluded, as well as the current energy legislative situation in these two nations. Andthen analyzes the defects existing in the legal system of the Sino-Russian energycooperation from these three aspects.The next part refers to a canonical analysis of the Sino-Russian energy cooperation,namely, transnational pipeline questions. As the transnational pipeline is an essentiallink in the energy cooperation of the two nations, and combined with the lack ofinternational common view on the concerned legal issue, hence, the study of this problem possesses both the theoretical and practical significance. Firstly, it presents thelegal framework of the transnational pipeline and the issue of jurisdiction, after that,lists the relative principle of international law and the legal question for thetransnational pipeline. Finally it identifies the type of the transnational pipeline disputeand discusses the way to solve this problem.Eventually, it comes to the last part, that is, the analysis of the perfection of thelegal system of the Sino-Russian energy cooperation. It presents to set up the energyorganization and the resolution mechanism of the energy disputes under the multilateralenergy cooperation mechanism in the framework of Shanghai Cooperation Organization.Then, from the level of legal system of bilateral energy cooperation, it illustrates andanalyzes the establishment of the intergovernmental agreements, intergovernmentaltreaties of transnational pipeline and approaches of solving those disputes. At last, itmakes a suggestion about the perfection of the domestic energy legal system.
