Collective Ownership Of Rural Land Real Research

The rural land ownership system relates to every people's life and therefore, how to solve the prominent contradiction between human and land is not only a political problem but also an economic issue. With the deepening of China's urbanization and the frequent land expropriation, landless farmers problems turned serious and land dispute increased day by day. The problems about the rural land relate to collective land ownership system mostly. The rural land ownership revolution experienced land reform period, primary production cooperatives, a senior production cooperatives, people's commune period. Finally it established the collective ownership form of three levels based at team. After the collapse of the people's commune, with collective farmland system remained, it has implemented the household contract responsibility system. Along with strengthen of national administrative power and contracted management, at present our country's collective land ownership is already in the air.I can't play the superiority of the collective ownership.The reason caused rural collective land ownership false are the following five factors,the main body of property right is not clear, boundary not clear, lack of the disciplinary right and no expression of earnings, lack of supervision mechanism. Because of the collective ownership's false, internally collective organizations have no the right to adjust the land accordingly and the collection can't the manage the land effectively and therefore fail to provide farmers with the normal public products. The collection can not paly game with state equivalently, protecting farmers'reasonable interest demand during land expropriation process.Marx's theory of property rights tell that the productive forces development decides property right relationship; the ownership nature decides ownership system. So the reasons to continue implement the collective ownership in our country are as following. First, it is decides by the level of productivity development, second, it is because of the current development situation of the rural areas. Third, it is because of the current situation of survival of our country farmers Therefore, only by insisting the premise of collective ownership, to visualize the ownership is the key to resolving the problem.Based on the theory of marxism and marxist ownership property rights theory, western theory of property rights as well, from the situation of rural farmer and rural land.This paper try to analyis the problem of the faulse of collective ownership in our country,the current situation and reason analysis of rights faulse.The author tries to discuss realification of ownership rights by five aspects. The first aspect is clear main body, through establishing village collective as agricultural land owner, guarntee economic organizations of the legal person status by electing all the villagers democratically legal representative, it confirm the ownership of main body, and realize the exclusive property rights; The second aspect is by defining the boundary property rights,(the boundary between the collective land and state-owned land) and clarify the property bundary; The third through the collection of reasonale rent of Farmers'land and the town enterprise,the country gives the farmer collective reasonable land compensation. Earning rights keeping collective organization operation itself,it can provide farmers with more convenient conditionse for production;The fourth is through the reasonable limitation of state expropriation rights and administrative power, give collective reasonable adjustment right of agricultural land, emphasize the collective first right of construction land circulation, carry out the farmland disposition, protecting farmers'interets basicly;The fifth, through the perfecting of democratic supervision mechanism, administrative supervision mechanism and legal supervision mechanism it carry out supervision mechanism of ownership system.
