The Research On The Supervision Mechanism Of Bids For Public Works

Public works as a kind of public goods and public resources, if be taken by administrative mandatory manner, are easy to cause the power rent-seeking, earmarking which will lead to negative corruption. According to article 3 of invitation and submission of bids law of PRC: all or part of the engineering construction projects using state-owned capital investment or state financing, including project survey, design, construction, supervision and the purchase of important equipments, materials, etc connected to project construction must be subjected to tender. At present, project bidding system as one of the basic resources marketization disposition systems has been widely accepted by all circles of the society, especially public works, as public resources, must be in accordance with the law, be taken bidding way to take market competition and configuration. It is the necessity of developing market economy requirements.But, there exists some undeniable problems in engineering bidding especially public project bidding in our country. Laws and regulations are still not perfected, the government supervision mechanism exists obvious disadvantages, without a clear line between the functions of the government and enterprises, multiple leaders on management, one-side supervision, local and department protectionism. Those problems seriously affect regulatory effectiveness. Corruption phenomenon during project bidding is quite serious and in some areas four consecutive chief of traffic department were deposed successively because of engineering problems. Engineering construction areas, especially the bidding field had become the anticorruption work of the worst-hit areas.This study aims to analyze the existed problems in our country public project biding, especially view from the government supervision, do research on government's role and duty performance in public project biding, to discover the existed problems and harm, and put forward countermeasures and recommendations from the aspects of perfecting legal laws and regulations, innovating supervision mechanism, establishing the service platform, etc, to optimize the public resources allocation, saving government funds investment, improve the construction quality, curb corruption behavior for the society to provide the general public with more public products of "high quality and reasonable price" of the, to better realize government's market regulation and public service function on project biding.This article is made up of five chapters:Chapter one is introduction. Have a brief discussion on the background, purpose and meaning, general research status both at home and abroad, research thought and main innovative points. Define public works and project bidding and related concepts. This paper expounds the generation of bidding system and the formation of the major principles, to define public project bidding scope, classification, main functions and effects from the aspects of fund management use, promoting the market economy and standardize market behavior.Chapter two are the status and question analysis on public project bidding regulation. Introduction of the development stages and status of project bidding. From four aspects of the analysis of different parties'behavior on supervision of project bidding, legal laws and regulations, the supervision mechanism, tangible market to analyze the main problems existing in the construction of the investment system, emphatically to analyze the existing problems in supervision mechanism level from the aspects of the defects, the dispersible bidding management system, the lack of regulation ideology and strength, violate compasses punishmentChapter three, parts of project bidding supervision mechanism reform practice. Key analysis on the existing problems and the insufficiency of Hefei, Anhui and Shandong Qingdao bidding supervision mechanism in the reform of the experience, measures and effects.Chapter four is the countermeasures and suggestions on the reformation of public project biding supervision mechanism.
