The21stcentury is a period of network, informatization and digitization, and theelectronic file has become the main recording medium by replacing the paper fileirreversibly and gradually, consequently, working, studying and living in daily life hasbeen a great change. Nonetheless, the problems in utilizing and managing have emergedalong with the growing of the electronic files.How to manage electronic filescientifically, effectively and normatively has been a problem, however, legalizationpoints the way for china's electronic file management. At present, the legal constructionof electronic file management has achieved some preliminary effects, but still has someproblems in it.This article focuses on two side of electronic file management legal construction:current situation and countermeasure. The key of the article is to give suggestionsthrough analyzing the weak points of electronic file management construction in Chinaat the new situation, and point out that the legal force of electronic file should bestrengthened in order to make up the gap of the existing laws and regulations, andenhance the harmony between regulations, strengthen the standard of electronic filemanagement construction, meanwhile, complete the local electronic file managementregulations, and then pay attention to the research and publicity of electronic fileregulations, simultaneously, draw on foreign legislative experience, aim to push forwardthe process of the electronic file management legal construction in China.
