The Evolution And Its Causes Of The Archive Legal System Construction In China Since 1949

As the true records of the human social activities,archives are the precious wealth of our Party and our country and are the important basis for national governing and carrying out the works.The legal system of archive,which commonly refer to the laws and regulations relating to the archives management,are the foundation embracing the archive legislation,archive administrative law-enforcement,archive administrative law-enforcement supervision,archive administrative review and archive law popularization that are subject to the function and power conferred by the constitution and laws,through which the state organs and citizens may manage the archive according to the laws.The archive legislation hold the dominant position in the archive legal system construction and this article mainly focusing on the historic development and its causes in the field of the archive legislative construction in China.The construction for archive legal system may be divided into four stages,that is the foundation and construction phase (1949-1966),the destroyment phase (1966-1976),the recovery and full development phase (1977-1987) and the perfection phase (1987-present). The author has mainly applied the historic and empirical research approach to introduce the content and development of the construction of archive legal system relating to the different stages,and to analyze the causes of the development and changes of the archive legal system from the economic,political and technical aspects on the basis of the relative legal documents that has been adopted since 1949. At the end of this article the author sum up the defects of the archive legal system construction in China and make several suggestions for resolving the problems which are existing in the new circumstances.
