| As the world economic and society developing, the awareness of animal protection has witnessed a continuing growing. To Maintain the ecological balance and harmony between man and the environment, the concept of animal welfare has made out as a consensus of the world. In recent years, however,what is of distressing and cruel, there still many activities abuseing animals in our country. People began to reflect on this sort of behavior and realized that only have the exist our current animal protection laws and regulations is not enough for the animal comprehensive protection. Domestic scholars urged animal welfare legislation aiming at establishing animal welfare legislation in China. From 100 years before, the British made the first Animal Welfare Act in the world. Until the current time,there are nearly more than 100 countries worldwide with the animal welfare legislation. This problem to be solved that facing our nation is how to transplant the foreign legal institutions and experiences of animal welfare in a circumstance of our politic and social conditions.This article is divided into four parts. The first part introduces the current situation of animal welfare legislation and its drawbacks in the light of a detailed analysis of necessity, feasibility and Legitimacy. The second part discusses the fundamental theory of animal welfare legislation, including the definition and classification of animal welfare, the origin,development, concept, characteristics of its legislation. Trying to clear animal welfare knowledge and concepts of animal welfare legislation in the theoretical basis of consensus. After then, this paper explores animal welfare legislations of UK, USA, Germany, studies each purposes, principles, institutions, implementing agencies and conservation groups, accompanied by a specific analysis of their legal responsibility regimes, trying to make a revaluation of western regimes. The fourth part is devoted to the conceive of a legislation of animal welfare in China. Currently, China has already issued a draft law on animal protection, the author hold in a favor of approvement and give some suggestions. |
