Study On Animal Welfare Law

With the development of society, the conception of animal protection has been accepted by more and more people. The ideas of protecting the ecological environment, keeping harmony between human beings and nature and protecting animals which are human's good friends have become the common sense of human beings. In recent years, some animals injured incidents such as"Liu Haiyang hurts bear with sulfate","Injecting water to living pigs","Eating cats"let us realized that animal protection in our society relied only on the strength of civil society does not work and we should strengthen legislation. The Animal Welfare Act in foreign countries are nothing fresh, as early as 100 years ago, the United Kingdom has make the first Animal Welfare Act. Until now, there are more than 100 countries which have laws about animal welfare. However, animal welfare is still unfamiliar for the most Chinese people and we lack the legal system about animal welfare.The paper introduces the conception of animal welfare, and focuses on the origin and connotation of the Chinese and West animal welfare theory. Based on the analysis of the conception of animal welfare, the paper compares the theory of animal welfare with the theory of animal rights and analyzes their differences and the sameness. In the third part, the proposition and evolution of Animal Welfare Act will be expatiated and the jurisprudential basis of animal welfare act is explained. The purpose of animal welfare act is not only to protect animal but also to safeguard human's interests, to improve our moral cultivation, to defend the public health and food security of our society. In the fourth part, the origin of animal welfare law in foreign countries and the Animal Welfare Law of the United States, Germany and South Korea are briefly introduced. And based on the introduction, some useful experience for China's legislation of animal welfare is proposed. The value significance of legislation of animal welfare, the deficiency legislation of animal welfare in China and the system conception of legislation of animal welfare are emphasized in this paper. This purpose of the paper is to promote the legislation of animal welfare, raise consciousness of the animals protection, safeguard the natural environment of our survival, and promote harmony between human and nature.
