Analysis Of Legitimacy Of Animal Welfare Measures Under WTO Law And China's Legal Countermeasures

With the rapid development of economy,based on the consideration of human morality and ecology,animal welfare has become a hot topic in the international community.At present,many countries in the world have formulated specific animal welfare measures according to their national conditions for the purpose of protecting animal welfare.In international trade,animal welfare standard is also one of the important standards related to trade.In recent years,many experts and scholars in China have called for attention to animal welfare and actively promoted the animal welfare legislation process on different occasions.Through the investigation of animal welfare measures in international law in the EU seal product case,the legitimacy of its existence is determined,and the shortcomings of the current animal welfare measures in China are found,such as the lack of animal welfare measures suitable for developed countries,the lack of making full use of WTO rules and policies,the lack of bilateral or multilateral agreements,the imperfection of the current legislative system,The content of the current laws and regulations is not detailed,the intensity of legal sanctions is insufficient,there is no reference to the implementation of the industry internal regulations.In order to effectively solve the shortcomings in China's response to animal welfare measures,it is recommended to make full use of existing WTO rules and dispute resolution mechanisms,participate in bilateral or regional animal welfare negotiations,formulate internal operating procedures of industry associations,and build animal welfare measures response systems.A series of operational measures,such as the contents of animal welfare laws and regulations,to achieve the purpose of promoting the common development of China's legal system and economy.
