Analysis Of The Current Situation Of Animal Welfare Legislation In China And Countermeasures

With the progress and development of human society,the concept and consciousness of protecting animals are becoming more and more popular,maintaining ecological balance and getting along with nature in harmony has become a common understanding of human beings.In recent years,the word "animal welfare" has slowly entered the field of vision.More and more people have gradually realized that the existing animal protection law in China can not achieve the purpose of protecting all animals.Many scholars have proposed to establish animal welfare law in China.On the whole,improving the welfare of animals is not only related to the healthy development of human beings,but also to promote the further development of our economy and the promotion of social civilization.In addition to the introduction and conclusion,this paper consists of five parts.The first part expounds the animal welfare and animal welfare law in two aspects,analyzes the basic concept of animal welfare,and integrates the relevant explanations of the relevant scholars at home and abroad on animal welfare,and studies the ethical foundation of animal welfare from two aspects of philosophical value and its intrinsic value,which can not simply pursue the "human center" We should respect the nature and give the humane treatment of animals;then we begin to describe the animal welfare law,start with the connotation of animal welfare law,analyze the concept and characteristics of animal welfare law,and analyze the historical evolution of animal welfare from the theoretical and legislative level.The second part describes the present situation of animal welfare legislation in China,introduces the legislation and practice of protecting animals from early to now,and evaluates the status of legislation in four aspects: first,the animal welfare legislation system in China is incomplete and comprehensive,and the scope of animal protection It is still very limited,which will indirectly affect the setting of animal welfare standards;second,the purpose of animal welfare legislation is not very clear and clear,and does not truly reflect the concept of environmental protection.There are too many principles in the existing legislation on animal protection in our country,and the operation is not strong;third,from the public.As far as the participation is concerned,our national public participation in animal welfare is not high,and there are many folk animal protection organizations,but the social influence is very small,the propaganda of animal protection is not enough,and the animal protection work can not be well supported.Four,the protection mechanism of animal welfare legislation is not perfect,for example,the supervision and management system,the establishment of rights distribution institutions are not very reasonable,the implementation of the legal responsibility is not clear enough,and the existing problems of animal welfare legislation are summarized.The third part,taking the more typical countries of Britain,the United States,Australia and Germany as examples,analyzes the development and characteristics of foreign animal welfare legislation,the effective implementation of animal welfare legislation and the legislative work of animal welfare protection at the present stage of our country.For example,Britain is the earliest proposed in the world.For the state of animal welfare legislation and the most perfect country in the current legislative system,we can learn from the legislative system,the purpose,the strength of the criminal law and so on to improve our country’s animal welfare legislation.The fourth part is to analyze the necessity of improving the animal welfare legislation in China,and improve the relevant animal welfare legislation to promote the smooth development of the economy,promote the construction of ecological civilization and ensure the physical and mental health of human beings,and then analyze the feasibility of improving the animal welfare legislation: as early as in ancient China,With the traditional culture of animal protection,many laws and regulations have paid attention to animal protection,and now in the time of rapid economic development,it has laid a good ideological,legal and material basis for animal welfare legislation.The fifth part,combining the contents of the foregoing description and the current environmental forms of our country,puts forward some suggestions to improve our country’s animal welfare legislation: we can set out from the legislative system,formulate special law of animal welfare,perfect the legal system,expand the enclosure of animal protection,and make areas for different categories of animals.To formulate different welfare standards for different animals,to clarify the purpose of animal welfare legislation in China,to truly protect the animals from the point of respect for animals,to strengthen the operability of the legal provisions,and to actively promote the public participation in animal protection,and the government can support and support the appropriate funds.We should develop animal protection organizations with certain influence,establish a reasonable and appropriate supervision and management system,and clarify specific legal responsibilities.
