Study On The Current Situation And Countermeasures Of Nursing Legal Risk Management

Objective: Through the cognitive research to the nursing managers, nursing staff and patients on nursing law risk and the current situation of risk management, understanding the organization and function of hospital, system construction and effect, risk prevention, control and treatment conditions, analyzing the main influence factors on the influence of nurses-patients relationship and nursing risk events occurring in the finally to provide certain reference for hospitals to establish a perfect nursing legal risk management mechanism.Methods:This study adopts the purposive sampling method, taking the questionnaire survey to108nursing managers come from58hospitals of the16provinces and cities across the country and11nursing managers,128nursing staff and147patients come from some three levels of first-class hospital in Ningbo who meet standards.Results:(1) The survey results of58hospitals:①Nursing managers'cognition to the related education training on nursing risk and risk management is the highest, but their understanding level to the related law and regulations of nursing risk is the lowest.②The main report form of the nursing risk events mandatory reporting system is paper report, there are few hospitals are not have any report forms.③There are five top factors on the influence of the harmonious relationship between nurses and patients:the media hype and public opinion influence, the defects in health system, maintain the enhancement of patients rights consciousness and information asymmetry and lack of communication, hygiene laws and regulations not perfect, the government financial investment insufficiency.(2)The survey results of Ningbo some three levels of first-class hospital:①Nursing staff at the age above36-45years old, work in above2-5years of the nursing and having the high degree of understanding to the risk relevant laws and regulations; Gender affect nursing staff's understanding to the department's risks of cognition; Different degree level of nursing staff affect the communication effect between nursing staff and patients; Nurses in the operating room have higher job satisfaction than other departments nursing staff.②The patients has the lower cognitive to the risk of going to the hospital.③Nursing risk management obtaining good effect from the organization's function effect and the legal adviser's function, but there is no full-time nursing risk management.④The report way of nursing risk events forced report system have both paper statements and network platform, the report actual implementation effect is good.Conclusions:Part of the hospitals in which were surveyed still have not set up the nursing risk management organization, or the effects is not obvious after the establishment. In nursing risk management full-time personnel set up and legal adviser aspects is also not good. The prevention of nursing risk in medium slightly lower level, although has made some preliminary results, there are still part of the hospital has not begin the work. Proposal to establish a perfect nursing legal risk management mechanism should start from the setting of organization and full-time risk management personnel; Establish the risk information network system covers the hospital nursing legal; Set up a perfect care risk management regime; Establish a perfect nursing legal risk transfer processing mechanism that from within hospital to outside the hospital, so as to implementation of the hospital and the patients with a win-win situation.
