The Public Participation In The Construction Of Environmental Protection System

The development of ecological civilization is a common career for all countriesand regions. The construction of ecological civilization in China has a great practicalsignificanse and strategic significanse. Building an ecological civilization is written thefirst time in the report of the17th National Congress by the CPC. The report pointed out:constructing the ecological civilization, transforming the industrial structure into theform of saving energy resources and protecting the ecological environment. Whenachieving a moderately prosperous society goals in2020,it makes China into a goodecological and environmental country. We will plan for the development of ecologicalcivilization in the people's Republic of China National Economic and socialdevelopment12th Five-Year Plan. In the outline, the Chapter24(increasing the intensityof the environmental protection) and the Chapter25(increasing ecological protectionand ecological restoration) reflect the degree that we emphasize on the ecologicalcivilization. In the Chapter25(increasing ecological protection and ecologicalrestoration),it's worth nothing that we focus on three aspects, namely, constructing thebarrier of ecological security,strengthening ecological protection and governance,establishing the mechanism of ecological compensation. These three aspects reflect thatwe put forward higher demand on perfecting the ecological legal system. By the reportof the17th National Congress and the12th Five-Year Plan, we can see that the legalsystem as a means of escort, we must consider a important problem: how can westrengthen and perfect the legal system.This paper, improving the legal system of ecological civilization as the background,emphasizes on the legal system of public participation in environmental protection.Firstly, we carefully analyses the jurisprudence of legal construction about ecologicalcivilization, and it points out that the correct and rational jurisprudence based on thelegal construction is necessary. So it contributes to the development of legal systemabout public take part in the environmental protection in China. Secondly, we analysesthe present situatiom of the public take part in the environmental protection, from whichto explore the problems, and to analyse the problem of its cause. Finally, in the above on the basics, from the beginning of building need for the legal system of publicparticipation in environmental protection, and then put forward some correspondingcountermeasures.
