The media judge phenomenon refers to the situation that the news media draw a conclusion on the judge in advance of the judicial department. Their decisions, whether directly or indirectly, shades influence on the final judicial judge on numerous aspects, ranging from the nature or degree of the sentence to the result of winning or losing a law suit. In the essence, the media judge is an excessive interference on the judicial judge which goes against the judicial impartiality and independence as well as the authority of the law in our country.In fact,2013is a year of significance in terms of the legal system, in which the media judge has exhibited many new features, with the close connection between the legal system and the rising media, such as the internet. Targeting on the typical cases of "Li Tianyi" and "the event of TangHui" and basing on theories of agenda-setting, silent spiral and knowledge gap, the present paper strives to specify the origin and evolution of media judge and the inevitability of its emergence; the innovative characteristics of media judge in the current network times; the interference of media judge on judicial judge and the meaning of the existence of media judge.In regards to the solutions, the researcher has proposed pragmatic measures to weaken and reduce the negative influence of media judge whether from the angle of judicial department, the media or the netizens. Specifically, the most fundamental method is to guide the netizens to receive relative education positively while accept the punishment passively. Meanwhile, to smooth the communication between the media and the judicial department under the condition of protecting the netizens’rights to know the facts, their right of speech and supervision and reducing the defects of the news media are all effective actions. The virtuous exchange between the media and the judicial department will contribute to transmit media concepts and ensure the authority of laws as well.
