With the development of Higher Education system reform, ruling the country by law and running education by law have become the developing trend of our Higher Education. However, the research of law application in higher education institutions is rather rare, especially in theory and practice. The writer has explored a little in this field. This article is composed of four parts: Part One Law Status in Chinese Higher Education InstitutionsFirst, confirming their legal persons' status and analyze their rights on the basis of law; following, analyzing their different legal roles; then discussing the presidents' law status, main responsibilities and the law relations within Chinese higher education institutions.Part Two Concept of Law Application in Chinese Higher Education InstitutionsSetting the concept of law application in higher education institutions through analyzing some scholars' remarks, deep into the concept from the aspects of subjects, objects, content and methods. Meanwhile, discussing its historical background and law background.Part Three Basic Rules of Law Application in Chinese Higher Education InstitutionsThis article has fixed the rules of law authority, running education actively and academic freedom. It has also analyzed their inside meanings, some expressions and important social relations.Part Four Analysis of Law Application Practice in Chinese Higher EducationInstitutionsThis article starts from organization management, personnel management, teaching & research management, education-running conditions management and student management, putting emphasis on some typical problems in these activities and making some relative suggestions.
