The establishment and implementation of the Criminal Compulsory medical procedures have a great impact on the realization of the building the rule of law and the protection of human rights.This article focuses on the analysis of the shortcomings of enforced implementation on existing mental illness procedures.It also refers to the current foreign countries' advanced experience and suggests some areas of the policy that can be improved.The article carries a detailed,comprehensive and in-depth analysis from four chapters as below.The first chapter talks about the basic theory of the criminal compulsory medical procedures,mainly on the knowledge such as concept,procedures,features,nature and value.It analyses comparatively on the similarities and differences among the criminal compulsory medical,psychiatric mandatory general medical and the ordinary criminal proceedings.It also lists the similarities and differences between the criminal compulsory medical execution and general criminal execution.All these analyses lay a solid theoretical foundation for the chapters to be discussed later.The first chapter talks about the basic theory of the criminal compulsory medical procedures,mainly on the knowledge such as concept,procedures,features,nature and value.It analyses comparatively on the similarities and differences among the criminal compulsory medical,psychiatric mandatory general medical and the ordinary criminal proceedings.It also lists the similarities and differences between the criminal compulsory medical execution and general criminal execution.All these analyses lay a solid theoretical foundation for the chapters to be discussed later.The second chapter lists the existing provisions of the criminal compulsory medical procedures,introduces the practice and experience of the implementation agencies,the cost,the supervision and the execution period in the foreign countries.These may help to improve the mental illness mandatory system in our country.The third chapter generally introduces our current situation and shortcomings of the execution of the criminal compulsory medical procedure.It introduces our nation's existing legal provisions and the implementation,lists the shortcomings such as unclear of the implementation agency and cost center,unclear of implementation supervision,unclear of the execution period,execution changes and unclear of the specification of the release condition.The fourth chapter summarizes the shortcomings listed in chapter second and analyses based on our nation's actual condition,refers to other countries' related implementation of advanced legislation,provides specific and operational suggestions and measurements.
