A Study On Several Issues Concerning The Crime Of Euthanasia

As human society fast develops, we enter a new era. The resource is utilized more effectively. Our material life is consistently improved and becomes more diverse.Nowadays, with all kinds of life improvement, people are no longer pursuing material blindly, and pay more attention to the physical and mental health. As one cannot choose his birth, does he, especially patients who are going to die, have the right to choose death? Death is people’s fear, dignity is people’s desire. For a man suffering serious disorders and torture caused by treatment, death can be a relief. The issue of euthanasia arises. Early euthanasia, which challenges people’s traditional ideas has caused controversy in the world. In the law field, the more prominent is whether euthanasia is criminal or not. Euthanasia is used to choose the manner of death, while criminal law is created to protect the priceless life. Today, there are several countries admitting the legitimacy of euthanasia by law, and the vast majority of the countries maintain negative attitude or keep silent towards for euthanasia. As for China,euthanasia is still treated as murdering cases. In recent years, Chinese medical condition is gradually improved. Being alive cannot meet people’s all need, the quality of life is paid to more attention.In this paper, through the view of nearly five years of the case, and summarizes some common problems about euthanasia in China and combined with the rapid development of today’s society, change our understanding of the euthanasia,euthanasia decriminalization of criminal law the question carries on the thorough discussion, and puts forward a proposal and opinion. The article mainly consists of three parts.The first part is introduction and mainly introduces the overview of euthanasia.The concept, characteristics and classification are described, and the analysis of euthanasia research status both at home and abroad in recent years are also introduced.The second part is analysis on contentious issues. Mainly through the case reflects the reality of the plight of euthanasia in China and analyze the reasons, makes a summary, and seek the balance of the law in legislation, judicial practice, put forward its own proposals and views.
