On The Legalization Of Euthanasia And Legislative Design

The issue of euthanasia is a social issue which attachs to many areas, and very complex and comprehensive. From it appeared, it has given rise to a protracted controversy. Whether euthanasia should be legalized? How will the legalization of euthanasia? Seeking institutional relief and filling the legal gap, which is the focus of this study and writing purposes. I intended to discuss this topic from the following five sections.The first part is the basic issues of euthanasia, and an overview of its actuality.It first explained the concept of euthanasia, theoretical classification, and confine the scope of this paper mainly to the narrow active euthanasia. Then introduced the foreign euthanasia legislation and the judicial process, focusing on analysis of China's legislative and judicial status of euthanasia.The second part is the fundamental analysis on the legalization of euthanasia.First of all,it has introduce the different views in theory,many views think the euthanasia is legal and proper. And then analyzed the reasons that behavior of euthanasia should be legalized legislative. Even though the situations are not very mature, but the legislation is just the issue of time, sooner or later. The following three parts will envisage our country's euthanasia legislation, system design and system construction. The third part is the legalization of euthanasia legislation.It mainly gives some suggestions to the topic.It suggests that National People's Congress should be the leader for the legislation. It suggests we should set up a new law called euthanasia law outside of criminal law.The fourth part is the physical conditions of the euthanasia legislation.It mainly discusses the physical conditions of euthanasia and the system design. First, the object which the euthanasia can apply to involves the identification of a number of important issues, including the terminally ill, the dying, suffering bearly; Can enthanasia apply to vegetative,the child who have serious deficiencies in newborns, patients with severe disability, and severe mentally retarded patients. Many have been suggested,like the subjective conditions, the body who apply for and the implement condions.The last part is the procedural conditions for euthanasia and the legal responsibilities of illegal euthanasia. It first proposed the idea of euthanasia procedural requirements, including the request process, review process, implementation procedures, monitoring program design. And about the system of the law responsbility against illegal euthanasia,it has put forward some ideas, and strives to stop euthanasia being abused.
