International Engineering Claims The Conditions For Success Study

With the arrival of the new century and the changing of the world market, the international construction market appears gradually intensive competition, and the contractors from different countries are facing unprecedented challenges,one of the most biggest questions is the"low profits resulting from low price bid". In order to dissolve this problem, construction claim has been put on the agenda. At the present time, construction claim has become a product brought about by the marketization of the construction industry, a rule played to balance the"buyer's market", and a key path for construction companies to receive compensation and improve economic effectiveness. Many expertizers regard the success or failure of construction claim as an important factor of measuring the success or failure of the contract management. Therefore, under the circumstances of claim is so important, exploring the conditions for a successful claim has theoretical and practical significance. If only make clear of the necessary conditions of a successful claim, contractors can overcome some shortages and make a good preparation pertinently, and conduct a smooth claim when the opportunity of claim is mature.This article is on the side of Chinese contractors, and the author begins it with the current claim status of Chinese contractors. At the first part, it states the important significance of successful claim and at the second part it analyzes in detail the necessary conditions and preparation if the contractors want a better job on construction claim with dividing the whole process into two stages: signing stage and executing stage. This article also has cited some true examples to prove the theory statements, and at last make a conclusion that claim is one of the important guarantees to live and develop for contractors in this competitive market. And If the contractors want to compete on and protect their reasonable economic profits, they must proceed claim all the time in the whole process of project and research successful factors seriously, at the same time make a good use of.Nowadays, the five years'transition for China to enter into WTO has ended. In the new historical period, I wish this paper can draw Chinese contractors'attention and provide some meaningful reference for them in the aspect of successful claim.
