Analysis On Claim Opportunity And Research On Claim For Extension Of Time Of Contractor Under FIDIC Contract

Claim has become one of the operational strategies and important measures which protect legitimate interests and efficiency of economy of many contractors in international contracting market. For vast majority of project, contractor usually claim in accordance with international practice and standard contract conditions chosen, therefore, this paper mainly based on FIDIC contract, by referencing theory and practice of engineering claims at home and abroad, using system engineering theory and network analysis technique, discussed the contractor claim, to provide reference and suggestion for contractor claim for compensation more reasonable, effective and high success rate. Basically get the following conclusions:1) From the angle of system theory, put claim analysis among the monitoring process of project implementation, constructed model of analysis of claim opportunity on basis of analyzing change control model of contract status, to abstract and simplify the claim and claim opportunity;2) Analyzed decision-making process of claim, expound concrete recognition method of contractor's claim opportunity on basis of analyzing contract, cost, progress and situation;3) Summarized procedures of claim for extension, and in the event of difficulties of it when many event crossover interference, doing deep analysis of responsibility and apportionment principle when appear common delay, proposed "initial delay decide period, share expenses according to liability ratio" principle;4) In considering start delay and time equation of process, put forward period claim calculation method for contractor when many event crossover interference based on analyzing the daley of process, this method provides scientific reference for clearing responsibility both sides and for contractor claim reasonably. Finally, combining with analysis of example, proved that this method is maneuverable and practical.
