Research On The Existing Problems And Countermeasures About Construction Claim In Building Projects

The concept of construction claim in building projects can be defined in a broad sense or a narrow sense. Generalized construction claim includes not only contractor to owner claim but also owner to contractor claim. In narrow sense, the claim only means that the contractor claims for compensation to the owner due to extension of time and increased cost not caused by self. The construction claim is studied only in narrow sense.With the rapid development of economy, construction contract has been become more and more internationalized. At the same time, there are more and more cases of construction claim. It is because of imperfect system, laws and regulations of our country. It needs to be researched and explored for domestic contractors how to maintain and expand the market share in the cut-throat competition in order to earn more profit and how to use international practice and law to safeguard their own interests.Firstly, relative theories about construction claim in building projects are summarized in this article. Secondly, the present situation and problems of domestic construction claim is analyzed. And then, countermeasures for domestic construction claim to be gained successfully are suggested from two aspects, one is to prevent in advance positively, the other one is to deal with afterwards positively. Lastly, it is made clear to be important to enhance risk management of contracts, to prevent outside risk positively and use critical path accurately in claim by cases analysis.Among the claim measures, the core problem in preventing beforehand is to strengthen contracts management. Therefore, researches of this article will be focus on method of contracts management on the basis of improve the ability of risk prevention.
