Study On Management Of Owner Claim Based On 99 FIDIC Condition Of Contract For Construction

With 99FIDIC condition of contract for construction applied increasingly in China, China's traditional model of engineering project management is changing irreversibly in China, especially awareness and level of engineering project management of owner claim has risen obviously. Therefore, study and use of 99 FIDIC condition of contract for construction was helpful to improve efficiency of claim management, it was helpful to maintain legitimate rights and interests of owners; it was helpful to solve a series of problems of claim fairly.The Chapter one, based on the actual problems of management, posed research background, research significance, present situation of research at home and abroad, research method, the main content and technical route of the study. The Chapter two introduced the basic theory of management of owner claim from the contract management angle, including the game theory significance of management of owner claim, basic content of management of owner claim, basic principles in compensation claim based on 99FIDIC condition of contract for construction. In a whole view of 99FIDIC condition of contract, the Chapter three analyzed contract clauses which can be cited for contractor and the owner, as well as procedure of claim and disputes-settling when claim took place. The Chapter four concretely analyzed contract clauses which can be cited for contractor, in order to provide contract evidence for claim preventing management of owner claim. The Chapter five concretely analyzed contract clauses which can be cited for owner on the basis of the contract, in order to provide contract evidence for owner who identified claim opportunity and took the initiative to claim, and an actual case cited in support of analysis in the last part of this chapter. The Chapter six summarized the main topics of this research, and made the lack of this research as well as prospects for the future research directions.As China's engineering market opened to the outside world deeply, we will have more and more international engineering contracting companies which have chosen the opportunity to enter China's contracting market. This is not only a tough challenge to the domestic engineering enterprise, but also bring enormous pressure to domestic owner, because most of the international engineering contracting companies have greater strength and a wealth of experience in project management, engineering claim owner will bring a lot of trouble on a certain extent, if domestic owner claim can not be effectively managed, they can not take the appropriate measures to counter claim, will inevitably suffer significant losses. Therefore, raising awareness of strengthening claims management claims has become a top priority.
