Chinese Grain Reserve System: Problem And Perfection

The crops problem is the most important thing in our life. It is not related to the income of peasants, but also related to economic development and social stability. Since the founding of New China, The Party and government which attach great importance to the security of the crops actively explore the establishment of appropriate national conditions of Chinese grain reserve system.In order to strengthen and standardize the management of grain reserves, the State Council issued the"Regulations the central grain reserves"in August of 2003, which established vertical management system, and defined the responsibility of State Council development and reform department, national grain administrative service division, Chinese stored grain manage related departments such as the head office . Have all done the clear regulation in purchase, reserve, rotating, drawing on and financial subsidy, bank credit, checking and supervising of the central stored grain and so on. These all promote the management of stored grain to step into the track of the law. But relevant legal provisions are not sound enough, and do not adapt the new the market oriented reform of grain circulation.At present, the results of studying on Chinese grain storage system are mainly in terms of economics and the management. The main view is to substantiate the stock scale, optimize the stock structure and overall arrangement, and improve control measures. These research results and policy recommendations are important to improve the system our grain storage. However, the studying on the institutional improvement about the law of grain reserves is still not enough. How to set up a complete grain reserves legal system is related to the reality of Chinese the security of the crops. My paper tries to put forward corresponding solution and suggestion from the visual angle of the law. Except introduction and conclusion, there are four chapters. The part one of my paper reviewed the development of our country's grain reserves, explained the necessity that our country sets up the vertical management system of grain. The part two of my paper analyzed to the problem and cause of our country's grain reserves. The problem which the decision-making mechanisms are not very flexible, the management and supervision system is not perfect. According to the principle of macro-control law, defined the goal of the grain reserves, the relation between government and marker, and cleared the legal status of the grain company. The part three of my paper drawed lessons from advanced law of the developed country. The last part explored how to use legal means to the grain storage system. Through the analysis of the change to the general theory of grain reserves of our country's grain reserves, the author believe that the system of our country's crops reserves of the objectives, decision-making, the management and the supervision of Chinese grain reserves are existing legal problems. Finally, the author makes the suggestion from grain reserves of the goal decision, the management and the supervision on some issue.
