In recent year, air pollution has developed into a serious environment problem in china. The pollution and associate consequences have post severe threaten to public health and sustainable development of economy and society. Significant amount of effort has been invested in preventing the deterioration of current situation, including rolling out the Environmental Protection Law of the People’s Republic of China and Law of the People’s Republic of China on the Prevention and Control of Atmospheric Pollution. Local governments also legislate against air pollution. But the laws, regulations and all the efforts did not mitigate the air pollution as expected; it even becomes more serious than ever. Air and environment pollution have become one of the most serious public and political concern. Environment, as communal products, is fatal for sustainable development, government has inescapable responsibility. Necessary laws and regulations were set up; agencies were in places and public appeals of environment protection were circling in the media. Why it still ends up with today’s situation? This paper tries to analysis the reason by focusing on the value of environment protection, balancing the economic profit, privilege and responsibility among involving entities; the experience of developed country in pollution control and prevention is also study as reference to enrich our portfolio for better solution.At first, the article enumerates the relative legal provisions about the control of air pollution and discusses the legislative evolution system of air pollution; then the article analyzes the main contents of the existing legal system of the control of air pollution. Due to the importance and effectiveness of lower grade provisions than the higher legislations of responding the prevention and control of air pollution, the article analyzes deeply the relative policies made by State Council and detailed measures provided by Beijing Municipal Government, which play an directly greater important role in preventing and controlling of air pollution. The article holds that present legislative provisions cannot content to the need of preventing and controlling of air pollution, the advanced concepts explored from the low-order provisions provide some clear ideas for the reform and development of air pollution legal system. In order to resolve the problem of air pollution exhaustively, we should establish the legal theory of environmental priorities, the balance of interest and government responsibility in Chinese air pollution legislation.
