Construction Claims Of Construction Engineering Projects Contractor

With the international economic integration, the construction enterprises have gone into the international market, participating in international competition in China. With open wider to the outside world, many foreign enterprises have swarmed into China. In the domestic, biddings are used for almost all building projects. For reasons from the owners', nature or society, the contractors in construction process, inevitably suffer some economic losses or delayed schedule. According to the contracts, the contractors shall have the right to put forward construction compensation claims for the loss from the owner.How can the Chinese contractors maintain and expand market share to make more profits in the intense competitive contracting markets, and how to use the international practices and standards to safeguard the lawful rights is an urgent research and exploration problem. Unfortunately, engineering practice is lack of effective guidance.The construction claims practice and the specific strategies are studied about construction engineering project contractors, from the view of the contractors, system, under the condition of FIDIC contracts. Firstly, this paper discusses the basic theory of the construction claims, gives the concept of the construction claims, analyses the connotation of the construction claims and classification. The significance for the contractors to strengthen the management of construction claims is demonstrated. Secondly, the integration of construction claims process is performed. The construction of construction claims organization and construction claims practice of each phase compensation are systematically studied, including finding claim opportunity, analyzing the terms of the contract, collecting evidence, formulating claim compensation strategy, submit claim report and solving dispute. Finally, the paper tells us to pay attention to the written claim. Then, a quantitative analysis of the difficulties, i.e. time claims and cost claims respectively. Claim principles, calculation methods and the problems should be paid attention to, which lays the foundation for the claim. Finally, through case analysis, in case of background, claim dispute, the arbitration results and the conclusion of cases, the paper presents the problems of the construction contractors should pay attention to, which including outside the wrong misunderstanding of bidding depending on low price, earnings depending on construction, paying attention to the cultivation of the contract management experts, taking use of supervision engineers, grasping the flexibility of construction claim and striving to friendly negotiated solution to claim dispute fully, etc.
