Study Of The Defect And Improvement Of Land Acquisition And Compensation System In Our Country

With the improvement of the social productivity and the acceleration of industrialization, the urbanization of our country is being quickened. At present, to the interests of the various, some organizations make haphazard plans to construct many development areas and industrial park on the farmland without control, which results in two problems: on one hand, the placement of the farmers who lost their farmland has become a serious problem, which is even more serious at the time when employment pressure of the whole world is increased while the social security system is incomplete, these farmers are termed as"three-nothing-farmer"—a new group-in-difficult, the weakness of the farmer without farmland has been strengthened which will make the social contradictions more serious beyond all doubt. On another hand, the fact that the area of farmland is melting down at a prodigious rate has become a direct risk to food security and ecological environment, which will possibly endanger the long-time peace of our country and result in heavy loss to the construction of socialism with Chinese characteristics.The scientific objective of this paper is to pay attention to people's livelihood, to ensure the legitimate rights and interests of farmers, and to construct the theory of harmonious socialist society. The system of land acquisition and compensation in our country is studied to find a new system which is effective in socialist market economy, promote land acquisition and compensation to the market and the legal system, and build a harmonious socialist society.This paper can be divided into four sections: in the first section, it discusses the fundamental definition, characteristics, theoretical basis and principle of land requisition and compensation; in the second section, the history of land acquisition and compensation in our country is reviewed and the main questions of the land acquisition and compensation nowadays are analyzed and the main reasons are discussed from the three aspects of law, economic and thought; in the third section, by comparing with the developed systems of land acquisition and compensation of some other countries, which tell how to improve the modern system of land acquisition and compensation in our country; in the fourth section, the principle and advices that how to improve the system of land acquisition and compensation in our country are presented.
