Legislative Study On The Quality And Safety Of Agricultural Products

Agriculture is lifeline of the national economy while the quality safety of agricultural products has direct impacts on consumers'health and life. As the rapid developing of economy globalization, trade internationalization and international trade of agricultural products, quality safety of agricultural products has not only to do with human health and life safety but also counts much for the national economic development and social stability. Since the entry of WTO in 2001, quality safety of agricultural products in China, which was highly recognized by all walks of life, has been the consistent focus of our "two sessions" over the years.This paper investigated the quality and safety of agricultural products in China's status quo, researched the legal system of this topic in typical developed countries of the world, and found a new point from the law perspective for quality and safety of agricultural products in China by combining with the Chinese advanced agricultural production results and the advanced experience from abroad. The direct objective of this study is to improve the legal regulation and control mechanisms of quality and safety of agricultural products in China, as well as its legal protection systems. The legal system improvements of quality and safety of agricultural products can help to promote the further development of the whole system in this field. This paper mainly focuses on the following sections:Chapter one is introduction. It introduced the research background, significance and existing studies on this topic, and proposed the methodology and objectives. This part put forward issues related to quality safety of agricultural products and lay a theoretical foundation for the study.Chapter Two is about the status and reasons of quality safety of agricultural products. This part introduced the main problems that quality safety of agricultural products in China faced and analyzed its reasons by adopting the economics method.Chapter Three focuses on the status in quo and its revelations of quality safety of agricultural products abroad. By analyzing the advanced management modes and law and regulation systems, we try to find the beneficial experience on dealing with the quality safety problems of agricultural products in China.Chapter Four lists the status in quo of the legal systems on quality safety of agricultural products in China. By analyzing the status in quo of the legal system, we raise some legal issues on the quality safety of agricultural products in China. This part also illustrated the shortcomings of legislation, legal liability, regulatory agencies, and legal system.Chapter Five demonstrates the legal strategy to solve quality safety problems of agricultural products and brings forward constructive suggestions from the legislation improvements, responsibility systems, regulatory agencies and regulatory framework perspectives.
