The Shortcomings And The Perfection Studies Of The Compensation System Land Levy In Our Country

With the rapid development of the urbanization in our country, levying land has become the main source of increasing construction land. The present compensation system of our country's land levy formed during the planned economy,which played an active part in the national economy then, but with the gradual establishment and perfecting of the socialism market economic system, its existing shortcomings are appearing day by day and the social contradictions caused by land levy are prominent,especially the descending of peasants' living standard and the unemployment caused by land levy are becoming increasingly serious and this becomes one of the most important factors that influence the lasting political stability of the society and an obstacle of establishing the harmonious society. By introducing the basic theoretic problems of land levy such as conception, characteristics,foundation and principle and basing on the present conditions of the compensation system of our country and consulting a large amount documentary materials, the article approaches the compensation system of our country's land levy and analyzes the shortcomings and causes of the present compensation system of our country's land levy. We should use the successful experience of land compensation system in other countries and try to perfect our country's land levy system in the following aspects: perfecting the law of land levy compensation, stipulating the compensating principle of " equitable principles" in the constitution; enlarging the scope of land levy compensation; establishing diversified forms of landcompensation; carrying out the compensating standard of "comprehensive land value of the district"; establishing the property right system of the collective land in the rural areas.
