Research And Countermeasure Discussion On The Problem Of Land Levy Of Shandong

The land levy is one of the social hotspots currently. For a long time, there are flaws in the land levy system of our country because of some factors such as unhealthy system, weak concept of law. In the new century, the urbanization is speeding up, which results in land levy dispute cosmically, the endless interest contest between the government and the farmers who lost their land, and many other social problems. Shandong is an important province in China both in economy and population. Besides, it is a represent in the aspect of the land levy for it locates on the front belt of the development of economy, but it has a small quantity of land and a huge number of people. The article is aimed to provide some advice for the improvement of land levy in China by investigate the land levy system in Shandong Province.There are mainly four chapters in the article:The first chapter is some basic theoretical illumination about the land levy. In the author's opinion, the land levy includes the purpose of levy, the procedure of levy and the compensation. In it, the purpose deals with the concept and standard of"common interest"; the procedure deals with concept, meaning and standard of the proper program; the compensation relates to range, standard and ways etc. This chapter is focusing on the problems that has been mentioned.The second chapter will introduce the general situation about the land levy in Shandong Province. First, the author will introduce the historical progress in land levy in our country and divide it into four phases by the signs of related laws. Second, the author will introduce the progress of the local legislation in Shandong Province and analyze the historical characters of the laws on land levy briefly.The third chapter will focus on the present situation of the land levy in Shandong Province. On the one side, the author will introduce the efforts and progress the provincial government made to improve the land levy system and solve the disputes on land; on the other side, the land levy needs to be reinforced considering about the validity censorship of the purpose, the establishment of proper procedure and compensation for the loss of the farmers reasonably. Besides, the conflicts won't disappear only depending on the improvement of the current system, because the execution of law will meet some difficulties in reality.The fourth chapter will put up some legislature suggestions to perfect the land levy and put forward the construction of the legislation. Firstly, it is necessary for the government to strengthen the validity censorship of the purpose in the land levy, to make the legislation of"common interest"clear, and more important to restrain it. Secondly, talking about procedure, the government should reinforce the system of the public decision-making process and improve the judicial relief mechanism to guarantee the right of the farmers who loss their land. Thirdly, considering about the compensation, it is suggested that the government should reform the standard of compensation and cancel the different standard between citizens and farmers step by step to protect the interest of the farmers practically. Considering about the method of the research, the author put the theory and the practice, the history and the reality, the national policies and the local problems together, and made contrast between Shandong and the neighborhood provinces. Furthermore, in order to provide solid evidence, the author also used some graphs and data.This article has some innovations. First, the author overcame a lot of troubles to collect the national legislation and the local laws of Shandong Province since the founding of new China. And then he studied the characters of these laws. In order to find out the track of the legislature in the land levy system in China, the author also compared these characters according to the purpose, the procedure and the compensation in land levy using forms. The track is also a microcosm of the history in the change of legislature in China. Second, the author made comprehensive conclusion and comparison on the efforts and progress in the land levy the governments across the Shandong Province made in the recent years. Besides, the author also compared the laws between Shandong Province and jiangsu, zhejiang and Guangdong to find out the flaws of the land levy in Shandong and finally put out reasonable suggestions.
