Covering 71% of the earth’s surface of the ocean, not only is the cradle of life, also is an important part of the earth in the whole ecosystem. The vast and wide ocean, has a wealth of resources to provide mankind with a myriad of features and benefits. In addition to providing basic support to survive life on Earth, the oceans is also an important part of the world natural and cultural heritage. Biodiversity is the foundation of life on Earth.Nowadays more and more attention to the protection of the Marine ecological, international society have made relevant laws and regulations, establish the protection system, to prevent degradation in the Marine ecological environment and Marine biodiversity loss, and ensure the sustainable development of Marine resources. Habitat change is the direct driving force causes of biodiversity and ecosystem change, so as to protect marine biodiversity, ecosystems, wildlife and natural heritage, the establishment of marine conservation areas have played an important role.This paper is aiming at putting forward comprehensive countermeasures based on the present situation and main problems of the Marine biodiversity in the opinion of domestic and foreign scholars, and expounding the international framework of existing international Marine biodiversity and Marine reserve, in the meanwhile researching th status quo of European Union and China’s legal system of Marine biodiversity conservation. Marine protected areas are used in this paper as examples through analysis and comparison upon showing differences between European Union and China’s current related laws about Marine protected areas. And the analysis lays emphasis on following three parts, the legislative status quo of Marine protected areas, the construction of the Marine protected areas, and the Marine reserve management system of comparative analysis. analyzes the existing reserves of the insufficiency of the legislation and management system, thus the analysis of Marine biodiversity conservation in China the lack of legal system, and puts forward concrete Suggestions of perfecting our country’s legal system of Marine biodiversity. Only if we have perfected the legal system of Marine protected areas constantly, strengthened the management of Marine protected areas, furthered the cooperation with international organizations and fully learned the advanced legal system of international marine biodiversity protection, at the same time, constantly improving the research level of Marine scientific, strengthening the public participation, strengthen the public participation, thus further realize the coordinated development in protecting and rational utilizing of Marine resources, so as to promote a virtuous cycle of social economic development and the resources and environment.
