Study On The Law System Of Information Security In The Network Environment

With the development of information technology, the 21st century went into the information age to the core of network. The typical features of this period were information and networking. On the one hand, network promotes Social and human being progress,especially the Economic Development; on the other hand, phenomena caused by network such as information pollution,information infringing and information destruction are growing. And network information security issue is becoming more and more prominent. It has also become an urgent social problem.Network information security is a complicated,comprehensive issue. the law is one of the most important means to safeguard the network information security.Now, in our country, information society and internet technology are at the stage of rapid development. But relevant laws and regulations were lagged. The force of laws were lower and imperfect, they cannot meet the demands of protecting network information security and promoting information society development. So, it will have the very important strategy meaning to create the sound system of information security laws and regulations in the network environment.This article begins with concepts of information security, it firstly emphasizes the connotation of information security, synthesizing the different experts and scholars' views from both home and abroad and some typical domestic cases,it introduces the main form of expressions and characteristics and types of crime about network information security. Then the article summarizes the law system of network information security,shows the necessity and principle of network information security legislation. Then points out the content that the law system should include Forming the point of view of an overall planning.In the third chapter,emphasizes the overview of network information security legislation system both home and abroad. First ,introduces the status quo of network information security legislation in our country, illustrates problems of domestic network information security legislation through examples analysis method, then disscuses the legislative history of developed countries, such as America,Russia,Britain and so on. At last, summarizes the useful experiences of developed countries. It is an important step to prefect our legislation system that combines the useful experience with China's national conditions.Chapter four is the core part of the dissertation, according to the theory discussed above,I illustrate the feasibility strategy that how to optimize the egislation system, the key of the legislation system construction are management and technology. These two things constrain and contact each other. The premise is the standard safety technology of network information system, it is the safeguard that planning by authoritative body and performing the law enforcement sector' duties clearly. Besides,on the point of the force of law, we should optimize the operability of the network information security legislation system from Criminal law,basic laws and departmental regulations.Perfecting the network information security legislation system,will contribute to encouraging the legislation construction in the information area and punishing cyber crime. Based on the development of current time, we made certain investigations and discussions, has certain significance to safeguard the network information security and promote thee healthy development of information construction.
