The Reflection To China’s Network News Information Legislation

The rapid development of Internet has highly boosted the spreading of information, providing people with the access to free speech. Nowadays, information dissemination on Internet has been applied to almost all fields of human society and become an indispensable part of modern life. The Internet has helped to provide various groups of people the right to make appeals concerning their own interests much faster than ever. On the other hand, the negative effect brought by the news on the Internet also deserves our attention. The constant appearance of those speeches which conveys the meaning of harming national security and public interest or helps spread vulgar information calls for our urgent action to make laws on information dissemination on Internet to regulate its healthy function.In1994, the first legal document on regulating the Internet was carried out in China, namely Internet Information System Safety Protection Regulations of People the Public of China. Since then, under the supervision of Chinese government, the process of making laws on the Internet has been sped up to the standard of perfection.Based on the legal documents of Internet information dissemination in the network legislation of China and the relative content of making laws on the Internet in other laws,this paper tries to analyze the influence they have exerted on regulating the development of the Internet news spreading in China, and to find out the relation between the present law-making situation and social realities at the same time, aiming to help improve the process of network legislation.Technically, our network legislation is the complementary of laws on traditional media. It belongs to the field of administrative legislation, with increasingly strengthened control. As to its drawback, firstly, many regulations in Constitution are still impractical in operation on the macro level. Secondly, the backbones of legislation are inevitably multilevel. Thirdly, the situation of pragmatism, which advocates the principle of "quickening the steps of making laws in urgent" as well as the coexist of party and government management and legal controls remain remarkable when the relative laws are applied into practice. We should pay attention to all of these issues.The authors believe that, the contradictions in the present network legislation are as follows:the one between legal principle, the one between present laws and regulations, the one between network technology and the one between real life. All of these contradictions will exert the influence on our life to inspire our to think of effective ways to minimize the inconvenience.It will be anything but an overnight success to improve the network legislations, a project of system requiring endeavors of all aspects. The author thinks that, the core of the network legislation lies in the fact that the Internet should be used to our advantage, and meanwhile, the right of free speech should be guaranteed without damaging the national and public interests and a lot of work should be done make it come true.
