The Relation Between Judicial Adjudication And Press Supervision

In recent years, the relation between judicial adjudication and press supervision has become a hot point of same solicitude in society and academy circle. A lot of scholars give sharp criticism to the "trial by media". They think the media report and comment of the judicial activity will easily form "trial by media". And thus it makes it difficult for the court to keep fair and justice, and in this way it invades the independence of judicial organs.What kind of influence does media reports and the following public opinion affect judicial adjudication? What the property of " trial by media " is? This paper attempts to illustrate it from two aspects: theory and judicial practice.The icea of the objection "trial by media" is from "the judicative independence" which is established from the foundation of "three powers sign separately". But such theory foundation is obviously nonexistent in China. The judicial system of Chinese special features and the judicial environment that it brings, impossibly let us carry on "the logic reason" that certainly think according to the traditional western idea. We should contact concrete state of the nation of China while drawing lessons from the successful experience of the abroad. Otherwise, the theory that has not practice foundation must be frustrated although it may sound convincing logically. In China today, prior consideration of the construction of the press supervision is better than emphasizing judicial independence and excluding the press supervision.
