The Conflict And Balance Between Media Report And Criminal Trial

The rapid development of mass media,and network media,the information transmission channels more widely,communication and access to information more convenient,in such an era of information explosion,caused by information dissemination influence should not be underestimated.Along with the enhancement of citizen's democratic consciousness and the progress of the rule of law,the desire of citizens to participate in social management is becoming more and more urgent.Judicial power is a kind of public power,which belongs to the category of social supervision,but there are conflicts and contradictions between media reports and criminal trials.This paper analyzes the current situation of conflict between media reports and criminal trials,analyzes the nature of conflict,and draws on foreign experience to find a way to balance the relationship between the two.This paper is divided into four parts:The first part mainly discusses the legislative basis of media reports and criminaltrials,including the freedom of the press,the right to know and supervise the public,and explain the relationship between the source of rights and the criminal trial.That the rights of media reports from the public freedom of speech and right to know,is the citizen to participate in social affairs,the basis of public opinion supervision.News reports are an important way to conduct public opinion and meet the public's right to know.The second part expounds the present situation of media reports and criminal trials in China,analyzes the situation of media reports and criminal trials in practice by analyzing typical criminal cases,and analyzes how media reports affect criminal trials.Media reports have not only positive effects on criminal trials,but also have negative effects.The reason for the conflict is that the value orientation and the social function of the two are different,which creates a conflict.In the third part,the author analyzes the experience of dealing with the relationship between criminal trial and news media in foreign countries.Through the analysis of the common practice in the process of dealing with the relationship between the judicial trial and the media news reports in the United States and Britain,and in some specific system settings,we can learn from the useful experience and measures that can be used in our country.The fourth part puts forward some valuable suggestions to balance the relationship between media coverage and criminal trial.To improve the corresponding system and to comply with professional ethics in their respective fields.Nor can we restrict the media coverage for the independence and justice of the trial,we should establish a good communication and cooperation mechanism,and construct a scientific and reasonable relationship between the media report and the criminal trial.
