A Research On Present Situation Of Rural Children's Right To Education

Recently the protection of rural children' right to education is the focus of attention in the field of theory as well as the emphasis content in compulsory education law. The knowledge of the real situation of rural children' right to education is the beginning of making related policies and laws. The thesis researches into rural children' right to education from the angle of actual right. Due to the absence of the appraisement index system of rural children' right to education, I construct an appraisement index system of rural children' right to education on the basis of others' studies. The system is divided into three parts, which are the situation of rural children' right awareness to education, the situation of the actually enjoyment of right to education, and the situation of the remedy for right to education. By this index system, the author conducts an investigation into a middle-level rural county.Through the investigation it is found that: On one hand, rural children' right awareness to education has been generally improved, and they will protect their due rights by all kinds of remedy approaches when their rights are infringed. Rural children' rights to education which children actually enjoy, such as access for children, assistance for poor children and girl's education are also greatly developed. By the help of many people in the society, exceptional children' right to education is gradually improving, too. On the other hand, the condition of rural children' right to education is also worried. The problems stand out: exceptional children are also facing access trouble. The rate of children' dropping out is very high especially in junior middle school. Family education has long been absent as well as a series ofproblems……Now, the condition of rural children' right to education has aroused people's anxiety. There are many reasons for children' right infringed, such as poor family, bad teaching qualities, investment system of education, transition of society and so on. Only do we analyze the causes, and take effective measures, through joint effort of the whole society, rural children' right to education can be guaranteed.
