An Anatomy Of Causes And Controlling Policies Of Crimes By Disabled Persons

The statistics shows that there are over 500 million disabled persons all over the world. Among them, to date all kinds of disabled persons living in China amount to more than 60 million, accounting for approximately 5% of the population of China. One fifth of Chinese families are affected. Facing the severe competition in the modern society the disabled persons are usually in a weak position due to their own physical and/or psychological problems, and, thus, what we can do is to deeply share their feeling and to pay more attention to their working and living conditions. However, the crimes committed by the disabled persons show a upward tendency in the whole country. Not only the quantity of the cases is increasing dramatically year by year, but also criminal behaviors are diversified, and further grow a tendency towards violence and organized crimes. A series of social problems caused thereby impose a great impact on the social stability and development of our country which is still in the process of social transformation. Furthermore, it also arouses the close watch of the judicial departments and the law society.Starting from the study on the physical and psychological natures of the disabled persons and in association with the specific social and historical conditions and cultural background of China, this dissertation intends to, on the basis of numerous statistic data and precedents, make a deep analysis and research on the current status, characteristics, reasons and controlling policies of the crimes committed by disable persons in China. This dissertation gives emphasis to analyze on the causes and controlling policies of crimes committed by disable persons and puts forward creative opinions on the matters such as improvement of criminal liabilities of disabled persons under the PRC Criminal Law, psychological correction of disabled offenders and construction of the criminal justice working system for disabled persons. This dissertation includes four parts in addition to a preamble.In the preamble there is a brief discussion on the importance of prevention against the crimes committed by disable persons The main text includes four chapters.Chapter One: General Description of Crimes Committed by Disabled Persons .First, it defines the concept and scope of crimes committed by disabled persons. Second, to compare the provisions of criminal liabilities for disabled persons between China and other countries in the world, and to put forward improvement opinions towards the limitations of the relevant provisions stipulated in the PRC Criminal Law.Chapter Two: Review on the Current Status and Characteristics of Crimes Committed by Disabled Persons.By presentation of numerous statistic data and actual precedents, it thoroughly comments on the general status, models and characteristics of crimes committed by the disabled persons in China.Chapter Three: Causes of Crimes of Disabled Persons in China.Starting from a research on the factors such as society, education, individuals and victims, this Chapter conducts a thorough analysis on the specific causes of crimes of disabled persons. Chapter Four: Policies on Controlling Disable Persons'Crimes.Basing on the causes of crimes of disabled persons, this Chapter highlights that improvement of social security/supports and strengthening of the psychological correction of disabled persons offended are valuable for prevention against crimes of disabled persons. Further, this Chapter thoroughly discusses on the principles of criminal sanction applicable to crimes of disabled persons and the construction of the criminal justice working system for disabled persons.
