The Research On Emergency Law System Of Chinese Unexpected Social Security Incidences

At present, the frequent occurrence of unexpected social security incidents at home and abroad has been a global focus. These unexpected social security incidents not only test every nation's emergency management system dramatically, but directly affect a nation's political security, social stability and economic development. As for China in the transition period, how to deal with these unexpected social security incidents timely, peacefully, effectively and properly has become a grave issue facing our party and government in the certain period in the future.After terrorist attacks on September 11, western developed countries, represented by the United States, have made prominent achievements both in the level of the government's management practices and in the level of theoretical research in the academic field. From emergency management practices in the developed foreign countries, we can see that they have a high standard in the research on emergency management of unexpected social security incidents, a relatively sound emergency management system related to unexpected social security incidents has been established, emergence responses gradually have been improved and perform effectively. In the academic field, in the same way, researches centering on emergency response to terrorism have been strengthened, producing a large number of practical and advanced fruits.Compared with developed western countries, at present, our government and academic field pay more attention to emergencies concerning natural disasters, accidents and public health. When it comes to social security incidents, both theoretical researches and practical policies are weak, and the sound emergency system has not been formed. In addition, the systematic research on emergency in our modern academic field started late, and we are at the initial stage in the emergency law construction of unexpected social security incidents. Compared with foreign countries, there are a multitude of disadvantages in our country's emergency management system and mechanism.As for research methods, based on theoretical exploration, this research tries to analyze and explore the strategies concerning the mechanism of unexpected social security incidents in our country using the method of integration and comparison. The research was divided into four parts.Part I: From perspectives of a host of concepts and categories related to emergency, the research defines the connotation and denotation of emergency , then illustrates the harmful consequences of emergency from three respects, namely threatening lives, threatening social stability and influencing economic development. Partâ…¡, The research on the emergency legal system construction of foreign country's unexpected social security incidents. Based on comparisons of emergency management mechanisms of the three representative developed countries, The United States, Japan and Russia , the paper summarizes the main characteristics of the three countries'emergency management mechanisms in order to provide references for the establishment and improvement of our country's emergency management system in unexpected social security incidents. Part III. This part analyses the legislation status in response management of unexpected social security incidents in our country, which was also compared with the laws of response management of unexpected social security incidents in developed countries, and summarizes the main problems of emergency law construction in our country's unexpected social security incidents. Part IV. From the perspective of the improvement on emergency law system of our country's unexpected social security incidents, this paper gives some suggestions on how to improve emergency law system of our country's unexpected social security from five respects.
