| The paper explored the cause of the increment trend of malpractices and found the main reasons of doctor-patient dissension, based on the investigation of malpractice judgment reports in Jinzhong city, Datong city and Yangquan city in the last two years. The results can provide scientific information to prevent and solve the doctor-patient dissension. 20 medical administers, 128 medical workers, 130 patients were investigated in three city-hospitals and two county-hospitals, and 77 judgements of malpractices were analyzed. The results showed that there were different between the doctors and patients in cognitive on the doctor- patient relationship and the law to deal with the doctor-patient relationship. In addition, the service attitude to the patients of some physicians was not good enough, once the bad outcomes appeared, the medical dissention could happen likely. The aged older than 50 years and the children younger than 10 years were main population of medical dissension, and the department of gynaecology and obstetrics, general surgery and orthopaedics were the high risk departments of medical dissension in hospitals. Aimed at the above results, the legal system should be propagandized in order to advance the establishment of the legal system and make it consummate. One side, the cognitive difference between the doctors and patients can be eliminated and the specificity of the medical work can be accepted by the patients if they knew the medical knowledge and the relevant laws. On the other hand, it should be benefit to solve the medical dissension that making the legal system perfect and providing legal judgement. Furthermore, it is necessary to communicate with patients for doctors and thus a harmonious relationship between doctors and patients can be built. At last, the intervention should be done and preventing mechanism of the medical dissension should be established to eliminate and control the medical dissension.
