On The Implementation Of Legal Obligation Of Local Government 's Environmental Protection

Local governments play an important role in the process of ecological civilization construction. There are many regulations about the obligations of environmental protection of local governments in the environmental protection law and many environmental elements laws which are connected with the atmosphere, water, and soil. The implementation of local governments’environmental legal obligations has improved a lot than before, but there are still many problems to be solved. There is no fundamental change to the environment. To the local government and the competent department of environmental protection and other relevant departments, it is urgent to carry out the policy of the central government and higher levels of government resolutely, to strengthen the ability and system construction of environmental protection constantly, to fulfill their environmental legal obligations strictly in accordance with laws.Firstly, putting forward theory foundation of the local governments’ environmental legal obligations, defining the concept of environmental legal obligations, local governments’environmental legal obligations and implementation of the local governments’environmental legal obligations, putting forward the theoretical basis of the local governments’legal obligations, which is the Public trust doctrine, the Externality theory, the Administration according to law theory, to make theoretical preparation for the following research. Then, on the support of the jurisprudence basis, to do a comprehensive summary of the content constitution of the local governments’ environmental legal obligations which is in the environmental protection law and environmental elements laws which are closely related with the atmosphere, water, and soil. And analyzing the content of obligations, dividing the types. Thirdly, to study the existing obstacles of the implementation of local governments’environmental legal obligations, to study the successful experience in the process of implementation of the local government environmental legal obligations abroad. Finally, combined with the recent policy and system design, putting forward rational suggestions from ability and system construction which is aiming at the existing problems of the implementation of local governments’ environmental legal obligations.
