Research On Environmental Quality Responsibility Of Local Governments

Since the 18th National Congress of the Party,our country and the Party’s ideas on improving environmental quality have been constantly enriched and perfected.At present,the quality of the atmospheric environment,the water environment and the soil environment in China has been improved,and the problem of ecological destruction has also been preliminarily contained.The legal system on environmental protection has been gradually improved,the battle against pollution has been steadily advanced,and the concept of environmental protection of the common people has been strengthened.However,the environmental quality of our country has not been fundamentally changed,and the environmental quality of individual areas is still severe.For example,in the first stage of the special regulation of drinking water sources by the Ministry of Ecology and Environment in May 2019,it was found that the water sources of local people’s governments at governments at various levels Class environmental problems 3626.Local governments are the main force in improving environmental quality,and environmental problems emerge endlessly because local governments fail to effectively implement their environmental quality responsibilities.As a result,local governments still have to work on environmental quality responsibilities.Article 6,paragraph 2,of the Environmental Protection Law of the People’s Republic of China of 2014(hereinafter referred to as the Environmental Protection Law)provides a general provision for the environmental quality responsibility of local governments.The specific requirements for local governments to fulfill their environmental quality responsibilities are scattered in the Environmental Protection Law,and other separate environmental laws also show provisions on the environmental quality responsibility of local governments,such as the Water Law.Pollution Prevention Law,Air Pollution Prevention Law.etc.Local government environmental quality responsibility is the responsibility of protection.is a positive responsibility,more reflected in the legal obligations of local governments in environmental protection,need local governments to take certain actions to achieve.The content of local government’s environmental quality responsibility includes five parts,which focus on environmental protection from macro decision-making,organize the comprehensive improvement of urban and rural areas and improve the overall environmental quality,coordinate environmental protection,formulate environmental protection incentive policies and provide related services,allocate public environmental resources,and in practices environmental quality responsibility Implementation depends on specific legal systems,such as environmental protection target responsibility system and assessment system.inter-regional environmental cooperation system and total pollutant control system.There are also some problems in the environmental quality responsibility of local governments,which are mainly reflected in the content of responsibility and the implementation of responsibility.According to these two problems,the author puts forward some suggestions to improve the environmental quality responsibility of local governments in order to regulate the environmental behavior of local governments at all levels and consolidate the environmental quality responsibility of local governments at all levels.
