With science technology renovating, economy developing rapidly, and a consumer society persisting, a lot of waste come into being, especially hazardous waste. Hazardous waste pollution prevention has been one of the hotspot in the global environmental protection.In the course of hazardous waste pollution prevention, countries have developed a series of supporting legal systems of hazardous waste management, including: hazardous waste identification system, classification management system, licensing system and risk prevention system.The first part of paper describes the basic theory included the meaning of hazardous waste, characteristics, management ideas, and the principal legal systems. In the following four parts, respectively, for hazardous waste identification system, classification management system, licensing system and risk prevention system, the author compares China's legal system with other developed countries. According to the shortcomings of our legal system, through comparative analysis, paper focuses on the United States and the Europe's identification system; the United States classification system; the United States treatment, storage or disposal of hazardous waste permit system, German's licensing system, Hong Kong's hazardous waste disposal franchise system; the United States Superfund program systems and environmental pollution liability insurance system. In the basis of studying the national legal systems above, the author summarizes the common and features of the national legal systems, and hopes to propose amendments to improve our country's legal system of hazardous waste management with China's specific national conditions for a more systematic, scientific and operational hazardous waste management.
