Research On Community-Based Natural Resource Protection

Natural resources are the cornerstone of human civilization, human survival and development depends on the continuous use of natural resources, which is really the process of non-stop energy exchange between people and natural resources. Natural resources are essential goods for human survival and development, not only for human's food, clothing, shelter, transportation and other activities of life and production providing various types of materials and energy inputs, so that the production and reproduction activities in human society are able to be conducted, but also providing activities of human life necessary for the service functions of the ecological environment. Sustainable use of natural resources is related to the harmonious development of society. However, during a long period of time the implementation of the closed-end management neglects interests of the residents in the community around the region rich in natural resources, resulting in a serious conflict between the protection and the development, constraining the achievement of the right to survival and development of the local community residents, even for China's strategy of sustainable development poses a major threat. Therefore, how to achieve the positive interaction between natural resource protection and community development become the today's important issues in the protection of natural resources, Community-based natural resource protection as a new model will thus come into being.This article is based on the perspective of community development, exploring the issue of the theory and design of the system of the protection of natural resources. The author made use of literature, comparative analysis, empirical research methods, making a systematic exposition,which is the philosophy,values,principles and legal system of the community-based natural resource protection.The second part is the historical development and the comparison of natural resource conservation.This section have explained the protection of natural resources from the vertical and horizontal two aspects.The historical development of natural resources protection have analysed vertically the development process of natural resources protection from the original civilization,agricultural civilization,industrial civilization and modern civilization,drawing on natural resources protection mainly research the legal system through the comparison of foreign countries and regions community-based natural resource protection,which is to arrive at the experience of enlightenment of improving community-based natural resource of our legal system through the analysis of these two areas.The third part of a sample of community-based natural resource protection analysis and empirical studies,concluded with the status of community-based natural resource protection and the existing problems,and further reveals the rationality of the community-based natural resource protection in our country,having laid the basis of practice for the legal system of community-based natural resources in our country.Basing on the comparation of the second part and the empirical research of the third part,Partâ…£has provided the concept,value and principle of the legal system of community-based natural resource,which is laying a solid theoretical basis for the legal system of community-based natural resource in our country.According to the theory in Partâ…£,the fifth part is exploring how to build innovative community-based natural resource protection of our legal system,mainly from the main body for the legal system,the funds for the legal system,the emergency for the legal system,the security for the legal system,the responsibility for the legal system and the dispute settlement for the legal system with a view to provide policy recommendations and practical reference for government departments.
