Since the 1990's, climate warming has become the one of the focuses in international community .In order to curb the concentration of greenhouse gases in the atmosphere, a series of international climate agreements have been issued and the international climate institution has been basically established. The international community follow the principle of common but differentiated responsibility,developing countries and developed countries provide for different obligations. However, the implementation of the international climate agreement failed to get a better compliance.The national communications, financial assistance and technical support arrangements of the international climate agreement are faced with different levels of default. This not only weakened the effect of the actual emission reduction ,but also increased the difficult of future international climate co-operation . Study the reasons for its breach of contract, on the one hand, the interests consideration of compliance and compliance ability are the underlying causes of default, on the other hand, the ambiguity of the provisions and characteristic of the soft-binding in the international climate agreement are Institutional reasons . After more than ten years of development, although the international climate warming has not yet been a substantive solution, but it has been become the growing concern . Faceing the disappointing results of the reduction, the effectiveness and compliance of the international climate institution will be the focus of the era of Post-Kyoto.Completely discard the current institutional arrangement is not desirable because it means that the early loss of high transaction costs, a realistic approach to improveing the International climate Institution. To improve the transparency of the international climate agreement, to balance between efficiency and fairness , to enhance the penalties of non-compliance and strengthen the role of international law.
