A Study On The Scene And Logic Of Grassroots Environmental Supervision And Law Enforcement

Environmental problems is the problem of the world’s attention,as well as our country government and the public’s attention problems,environmental problems need environmental governance,environmental governance requires joint efforts between social subjects to reach to the target,the system is the key,the essences of environmental governance effect at the grassroots level,environmental governance effectiveness at the grassroots,grassroots environmental legal system of the implementation of effective environmental governance effectiveness,grass-roots environmental governance effect is of great significance for China’s environmental governance,affect the overall effect in environmental governance.The effective implementation of environmental law system depends on the organization and implementation,and the main body of implementation at the grass-roots level is the environmental supervision brigade.This paper takes NL County grassroots environmental supervision brigade as the research sample,and explains the relationship between grassroots environmental supervision enforcement action process and environmental legal system implementation from the perspective of new institution and legal anthropology.Logic is the paper,from the action of grass-roots environmental law enforcement inspection team,investigate cognitive environment inspection team law enforcement officers and law enforcement,law enforcement,law enforcement process effect,the description rules of environmental monitoring and environmental law enforcement action itself system differences and the reasons,and finally,using the related theory explain the logic of environmental monitoring law enforcement action and its legal system of the relationship between reconstruction path with the environment.The point of this paper is that although there is a gap between the process of environmental supervision and law enforcement and the implementation goal of environmental law system,it is generally characterized by gradual cooperation,reconstruction and steady development.This thesis has the following several parts: the first part is the first chapter,introduce the object of study basic situation,including the geographical environment,economic,cultural,and environmental inspection team’s own content such as organization structure,the study found that: the change of environmental monitoring system is the result of major events such key nodes,present system of the characteristics of path dependence.No matter the change of the organization’s name,the change of the organization’s internal structure and power allocation are all related to important nodes and important events.The second part includes the second chapter,the third chapter and the fourth chapter.The action process of the environmental Monitoring Group in the process of law enforcement is extended outward,including the microscopic study of action cognition,action strategy and action process.The analysis of law enforcement process is mainly explained through the author’s field investigation.On the one hand,environmental supervision and law enforcement actions are inseparable from organizational operation.The organizational operation of environmental supervision brigades is carried out by discussing the relationship between relevant organizations,especially the analysis of the role played by environmental supervision brigades among organizations.The degree of closeness between vertical organizations is related to the region;the game between horizontal organizations is related to leadership and ethnic composition;the human relations and cultural relations in ethnic areas permeate the process of environmental supervision and law enforcement,and the work beyond the responsibilities of environmental supervision brigade is more the result of compromise between the sub-bureau and other organizations.On the other hand,as far as the law enforcement team itself is concerned,the deviation of legal cognition of grassroots environmental supervisors leads to the deviation of behavior,and individual actions are characterized by limited rationality.The action strategy is mainly reflected by the discourse strategy,discussion control behavior strategy,multiple roles strategy and environment identification in the case.The strategy of individual action depends more on personal qualities such as language and role.Under the framework of the whole environmental law and policy system,the reconstruction of cooperation is the result of the function of system.The cooperation and final cooperation between the enforcement actions of the environmental supervision Team and the compatibility between the enforcement actions of the environmental supervision team and the environmental legal system are all achieved through the continuous exploration of the action preferences of the other party,which is characterized by local culture.Procedural law enforcement and legal law enforcement are the essence of action,but in ethnic areas,normative action contains non-normative factors,which are manifested through the individual behavior of law enforcement personnel of environmental supervision group,and it is difficult to find the reasons behind the behavior on the surface.In the normative analysis,members of environmental supervision brigade have differences in legal cognition,legal interpretation ability and other aspects,which are related to their living environment,preferences and rational choices.The third part includes chapter 5 and Chapter 6.Through the quantitative analysis of public satisfaction survey,it is found that there is a strong correlation between organizational cognition,legal cognition,organizational pressure,legal awareness and satisfaction,and the difference of economic income is not an important factor affecting the public’s demand for environmental quality.The construction of legal system and organization is the key factor of environmental satisfaction.Through the above qualitative and quantitative research,the logical relationship between environmental supervision and law enforcement actions and environmental legal system is further explained.The environmental law system regulates the environmental supervision and law enforcement,and the environmental supervision and law enforcement action can reinterpret the power operation state given by the environmental law system.The effective coordination and cooperation between the two can produce the effectiveness of the system.The conclusion part summarizes the research conclusions and holds that the research path of “small place,big problem”has value in explaining the relationship between environmental supervision and law enforcement and the implementation of environmental law system.The author also puts forward the deficiency of the thesis and the prospect of the research.
