Study On The Types And Optimization Of Environmental Law Enforcement Deviation In Grass-roots Units

Environmental law enforcement is the basic work to protect the ecological environment and a powerful weapon to achieve a high level of ecological environmental protection.As the smallest independent unit of environmental law enforcement,the district and county-level ecological environment authorities are at the forefront and the grassroots level of ecological and environmental protection work.The environmental law enforcement work they carry out is the "last mile" of environmental governance.However,in the practice of grass-roots environmental law enforcement,the problem of law enforcement deviation occurs from time to time,and there is still a certain gap between the effect of environmental law enforcement and the people’s expectations for a better living environment.The problem of deviations in grass-roots environmental law enforcement is,in essence,a problem of the use of discretionary power of street bureaucrats.Street bureaucrats enjoy a large space for activities because they have a certain degree of discretion,but whether or not they use their discretion,how they use their discretion,and what logic of action they will show depends largely on the industry they are engaged in.the internal and external environment of the organization.Different organizational environments such as organizational resources,interest drives,and external pressures bring choices for street bureaucrats to take different action logics.Based on the complexity and diversity of grass-roots environmental law enforcement activities,this paper firstly uses typological research methods to divide grass-roots environmental law enforcement into the daily law enforcement carried out by law enforcement departments at the county level,and the daily law enforcement carried out by law enforcement departments at the municipal level according to the different levels of law enforcement task sources.There are three levels of law enforcement activities and handling of cases assigned by inspectors at or above the provincial level.At the same time,the semi-structured interview method was used to select environmental law enforcement officers from J city and counties(cities,districts)in Shandong Province,and some responsible comrades of enterprises as the interview objects to analyze the types of law enforcement deviations shown by the grassroots environmental law enforcement officers in law enforcement activities.Through research,it is found that the grass-roots environmental law enforcement officers in J City have shown unique action logic in different combinations of three dimensions:resources,interests,and pressure.There may be selective law enforcement,perfunctory law enforcement,symbolic law enforcement,and mechanical law enforcement.Different types of law enforcement deviations such as law enforcement,and different law enforcement deviations do not appear in all law enforcement activities,but only in one or two law enforcement levels.The main reasons for the deviation of grass-roots environmental law enforcement lie in the lack of law enforcement incentives,the law enforcement department’s false responsibilities,the weakening of external supervision,and the limitations of existing rules.In order to rectify the deviation of law enforcement and realize the benign transformation of the problem of environmental law enforcement deviation at the grassroots level,it is suggested to improve from four aspects.The first is to improve the positive incentives and error-tolerant and error-correcting mechanisms for grass-roots environmental law enforcement to mobilize the enthusiasm of law enforcement officers;the second is to improve the grass-roots environmental law enforcement authority and responsibility system,to further strengthen special protections for law enforcement,to clarify law enforcement responsibilities,and to smoothen the internal and external relations of law enforcement;three It is to regulate the exercise of discretionary power and strengthen external supervision of law enforcement,so as to realize the regulation of grass-roots environmental law enforcement power and the restraint of law enforcement behavior;the fourth is to improve the comprehensive ability of grass-roots environmental law enforcement personnel by means of training and scientific and technological means,constantly standardize the law enforcement process,and realize technology-enabled law enforcement.personnel,and effectively improve the law enforcement efficiency of grass-roots environmental law enforcement teams.
