Research On The Problems And Countermeasures Of L City’s Environmental Administrative Law Implementation

In the past decades,China’s economy has made a significant leap,people’s living standard and sense of happiness have been gradually improved.However,with the rapid development of economy,environmental pollution getting increasingly worse,which poses great danger to life on the earth,and makes the environmental protection in China get more and more tricky.The official implementation of the New Environmental Law in the new year’s day in 2015 heralds a new chapter of China’s environmental protection work.To some extent,it can help solve the problem that the environmental law is not implemented thoroughly.With the promulgation and implementation of environmental laws,the enforcement of environmental administrative law should also be upgraded and strengthened in the new period.The enforcement of environmental Administrative Law is a critical task for the Department of Environmental Protection,and it is also a front-line law enforcement work of environmental protection.However,the enforcement of environmental administrative law at the grass-roots level differs from that in the urban,which needs to straightly deal with various environmental complaints and environmental violations.This paper aims to analyze the present situation of environmental administrative law enforcement in L City of Zhejiang Province,combining with the environmental administrative law enforcement in China,in order to seek suggestions and measures for improving the environmental administrative law enforcement in L City of Zhejiang Province.This paper adopts themethods of case analysis and literature investigation to study the environmental administrative law enforcement in L City.At present,the environmental petition is widespread and strong,whereas the number of environmental administrative law enforcement personnel of L’s Environmental Bureau isout of proportion,and the environmental administrative law enforcement equipment is scarce.Researches find that currently some problems exist in the environmental administrative law enforcement in L City: the partial failure of environmental legal system,the imperceptible management system of environmental administrative law enforcement,the unqualified environmental administrative law enforcement team,and the less active public participation attitude.The internal causes of these problems involve various aspects.Firstly,the top-level design in the field of environmental protection has its constraints,such as the lack of authority of legal system,low degree of identity,rigid principality,poor operability,and imperfect administrative penalty discretion standard.Secondly,the vertical management of the organization is not thorough.The environmental administrative law enforcement cross functions,and the government at grass-roots level exerts excessive intervention during law enforcement.Thirdly,the construction of environmental administrative law enforcement team is insufficient,such as the current law enforcement team cannot keep up with the demand,the law enforcement funds can’t function for long,,and the personnel training management mechanism is yet to be improved.Fourthly,the social supervision mechanism has flaws,including the lack of public participation willingness and the insufficient environmental knowledge education.Facing the harsh reality of environmental administrative law enforcement supervision in L City,this paper analyzes the causes for the problems existing in environmental law enforcement supervision,and puts forward the following countermeasures.First,consolidate the legal ground of environmental administrative law enforcement.Second,enhance the supervision mechanism of environmental administrative law enforcement.Third,upgrade the comprehensive level of environmental administrative law enforcement team.Fourth,strengthen the social supervision mechanism.
