A Study On Loss Texting Of The Value Of Marine Resource Property Rights Caused By Land Reclamation

Land reclamation is one of the important ways of marine space resources for city development. It expands the living space, provides an important production factor for the development of social economy. Reclamation will completely change the natural attributes of the sea. Therefore, whether the marine resource can achieve sustainable development and utilization depends on the science and rationality of land reclamation and whether land and sea can achieve the overall development also depends on the science and rationality of land reclamation. But,at present,there are defects in the land reclamation management,such as market failure,absence of government,backward management idea,inefficient managements system and low efficiency of marine resources utilization,which result in the serious loss of the value of marine resources property rights during the reclamation process. Therefor,it is of important theoretical and practical significance to make a research on the loss of the value of marine resources property rights, set the model to test the loss of the value and figure out the policies of governance with qualitative and quantitative analysis, normative analysis and empirical analysis. The conclusions of the dissertation are helpful for the marine management departments to strengthen the supervision and management of the land reclamation and provide a theoretical basis to prevent the loss of the value of marine resource property rights. It also does good to Marine Department to maintain and increase the value of marine resource asset,to figure out marine policies. The study on the value of marine resource property rights can change the idea of Marine Department or the user of marine resource,so that the marine economy can truly become a driving force for the sustainable development of social and economic.The dissertation summarizes the domestic and foreign research results, on the base of related theories, using the methods of comprehensive system, deeply researching on the following aspects:Firstly, for the comprehensive, scientific, reasonably reflecting the value of marine resource property rights, the dissertation puts forward the concept of marine resource development right (MDR), figures out the value of marine resource property rights, including the value of marine resource revenue right, the value of marine resource development right and the value of marine resource environment right. It sets up the three value‐added model of the value of marine resource property rights.Secondly, from the perspective of property rights, the dissertation analyses the essential difference between reclamation right and utility right. It indicates that reclamation right has the characteristics of the right to dispose.That directly result in the loss of the value of marine resource property rights.Thirdly, the dissertation analyzes the property efficiency from two aspects of the transfer process of reclamation with inframarginal analysis. One is the local government gets involved in the transfer of property rights, the other one is the local government gets non‐involved in the transfer of property rights. By contrast, the local government is the initiative driving force in the process of reclamation. The more intervention the local government does, the more loss will be in efficiency of property rights transfer.Fourthly, according to the definition of the value of marine resource property rights, the model to test the loss of the value of marine resource property rights is established, meanwhile, it gives the calculation method of marine resource reduction interest rate and the calculation method of the adjustment coefficient for the value of marine resource property rights. At last, by testing the loss of the value of marine resources property rights caused by land reclamation in QingDao, the paper verifies the operability of the evaluation model.
