Studies On Property Rights And Management Of China's Marine Resource Assets

On the basis of analyzing the differences of marine resource and marine resource asset, this article reveals problems in exploiting and their roots in economics of China's marine resource assets; then defines property rights of China's marine resource assets and designs better institutions of property rights. Based on it, the article provides property-rights-based management system of China's marine resource assets. The study concerns relative theories of environmental and natural resource economics, economics of property rights, marine management.The main contents of this article are as follows:First, this article discusses kinds and characteristics of marine resources, clarities the definition of marine resource asset, analyses the relations of them. Based on it, the article researches the definition of marine resource asset property rights and consistent of the rights.Second, by economical analyzing of problems in exploiting of China's marine resource assets under nowadays management system, it unfolds the internal contradictions of China's marine resource assets exploitations, and points out the defects in property rights institutions. Then, it gives the conclusions: to solve the problems in exploitations, the most important things that should be settled are to clarify property rights and better the institutions of them.Third, the article researches contents and principles of property rights definition. Under the demand of state own, it offers the idea of separation of ownership, operational right, and administrational right. Under the premise of state own, it clarifies rights and responsibilities of the rights.Fourth, through analysis of institutional objectives and innovational terms of China's marine resource assets property rights, the article innovates the implemented institutions of property rights.Fifth, the article designs and structures new property-rights-based management system of China's marine resource assets in which the country possesses ownership of the marine resource assets, but the administrational right is belonged to different governmental levels. And it also sets up combinational system of integrated management and industrial management.Sixth, the article designs double-restricted supervision system for the property-rights-based management system of China's marine resource assets. Seventh, in order to guarantee the high efficiency of the new institutions of property rights and property-rights-based management system of China's marine resource assets, the article investigates the ensuring countermeasures.The creational works of this article focus on:First, the article defines marine resource asset, and researches the consistent of property rights of it.Second, by thoroughly exercising theories of market failure and government failure in economical analyzing of problems in exploiting of China's marine resource assets under nowadays management system, the article unfolds the roots of the problems from different perspectives, and points out the defects in property rights institutions.Third, the article designs Tri-right Separation mode for China's marine resource assets and discusses the relations of ownership, operational right, and administrational right. At the same time, the article also structures the property-rights-based management system of China's marine resource assets, and designs double-restricted supervision system for the system.
