Study On China Smart Mobile Media Content Regulation:Reform, Inheritance And Practice

Media content has important influence on human cognition and behavior, and is closely related to social political consciousness, therefore, the intention and effort of content regulation always runs through the history of media. The study of media content regulation is a universal topic, especially in the background of new media challenging the old model of regulation, many countries are trying to seek countermeasures.Smart mobile media, the latest media, has many characteristics, such as highly convergence of media forms and content, extremely complicated content production pattern, the blend of public and private communication, mass UGC, and artificial intelligent applications, which disintegrate and trouble the traditional media content regulation. This paper summarizes the changes as:the restructuring of regulation, the failure of process control mode, the reconstruction of public and private space boundary, the reinterpretation of the public media literacy, and the appeal of two rights.The restructuring of regulation refers to, the convergence of media industry caused by smart mobile media forces us to consider establishing a more integrated regulatory framework, focus on clarify the boundary of media content regulation and the classification of media content.The failure of process control mode is mainly due to pluralistic communicators, random distribution opportunities, and cooperative production mode of smart mobile media. Therefore, the direct control which only aims at the professional media institutions does not work any more. A new mode of content regulation must be raised.Smart mobile media mixes public and private space, and makes the overflow from interpersonal to mass communication. Then the regulators should be cautious of the arrogation of public authority to private rights. It is important to clarify the boundary of interpersonal and mass communication, and define the rights and responsibilities when the overflow from interpersonal to mass communication happens.The mass inappropriate UGC on smart mobile media breaks throgh the centralized and unified administrative regulation framework. The significance of public media literacy becomes more and more important. In this context, this paper proposes that the new public media literacy should contain at least two kinds of abilities and three kinds of responsibility consciousness.The two rights refer to "the right not to know" and "the right to be forgetten". The former is supposed to solve the more serious information noise. The latter is supposed to safeguard personal information data security.Within the Chinese political and cultural system, media content regulation usually pursues the same and stable political and cultural values. This paper proves that, in the context of Chinese history, politic and culture, media content regulation is subject to the principle system model which consist of the party’s principle system and the social benefit principle system. Every principle in this model is very important and influences the media content regulation mostly. The principle system model is certainly stabile, not easily is changed by the media morphosis.After investigating of Chinese media content regulation practice, this paper finds that the regulators have already adapt to the new media environment, but so far, a content regulation system which is really suitable to the smart mobile media hasn’t been established. The traditional separate regulation mode still exist. Media regulation and telecommunication regulation haven’t been integrated yet. There is not a division of content layer, network layer, and service layer. The administrative regulation based on process control is still very prominent. The regulators have been aware of the personal information data security and commercial electronic information invasion, but hasn’t realized the meanings of "the right to be forgotten" and "the right not to know".Finally, this paper puts forward three major reform directions:constructing integrated regulation framework, a "self-regulation&co-regulation" model and information ethics system. Especially taking care of Chinese situation, the reform should be advanced gradually. The "self-regulation&co-regulation" model is also different from EU’s, which should consist of Party regulation, government regulation, media self-discipline regulation and public regulation.
