The Development And Evolution Of Network Audio Visual Regulation In China

Network audio-visual is the most common and most used network form.Like other network communication fields,there are a variety of problems,including infringement,piracy,obscenity,anomie and so on.Therefore,it is urgent to regulate them.China's regulatory practice in the field of network audio-visual has been nearly 20 years,and a series of regulatory documents and policies have been issued.The theory and Countermeasures of relevant regulatory and legal liability issues in academic circles have also accumulated,and gradually move towards the direction of systematization and scientization.However,due to the rapid development of the Internet,as well as the lag and defects of relevant regulations,it is often unsatisfactory in practice.Based on the analysis of all the current network audio-visual regulation documents and related literature and cases,this paper interprets the development process and evolution direction of China's network audio-visual regulation,and looks forward to the new path of China's network audio-visual regulation.This paper is mainly divided into the following aspects: first,the regulatory object of this paper is determined as the network audio-visual platform,the development status and problems of China's network audio-visual platform are introduced,and the necessity of regulation is explained;Secondly,based on the analysis of the basic objectives of China's network regulation,this paper combs the basic situation of China's network regulation.According to 52 regulatory documents published in China(up to February2021),the forms of network audio-visual regulation in China can be divided into administrative regulation,legal regulation and self-management,namely "heteronomy" and "self-discipline";Second,it is divided into two chapters from the vertical and horizontal perspectives.Vertically,it is mainly a diachronic interpretation of China's network audio-visual regulation,as well as its legal sources and subject changes;Horizontally,from the perspective of content regulation,such as relying on the content regulation standard established by "ten prohibited articles",the content regulation of live broadcast,and the regulation of network platform itself.Finally,through the analysis and summary,the author finds that there is a problem of discordance between heteronomy and self-discipline in China's network audio-visual regulation.Too "strict" heteronomy limits the relatively "loose" self-discipline,which leads to the two regulation methods can not play their maximum advantages.From this point of view,this paper believes that for the future exploration of China's network audio-visual regulation path,we can start from the platform and consider the third path-"co-regulation".
