Concerning The Regulation Of Internet Rumors Criminal

The rapid development of network technology brings convenience to people’slives, however, everything has two sides. Due to the lack of effective norms incyberspace, it is provide a hotbed for cybercrime, such as network rumors. Internetsrumors are false information, which are generated, released or spread on the network,and are not based on facts. Compared with the traditional rumors, internets rumorshave much rapid spread speed, more coverage and greater social harm, at the sametime much more governance difficulty. Currently, the networks rumors have the highoccurrence, and have aggrieved rights of individuals and have bad effects on thestability of society. Therefore, not only do we pay attention to the network rumors, butshould pay attention to seek countermeasures of prevention rumors. For networkrumor phenomenon, the author analyzes the reasons from three levels. The first issocial level, which is based on the context of social transition and the perspective ofthe government, which means the government is not enough scientific informationmanagement, in the area of some major events. Government’s positive reports do notelaborate, the channel is not smooth, and leading to the public can not be timely andeffective access to relevant information. The second is based on the group level. Thatmeans the network group is affected by the unconscious and the herd mentality. Thethird is the individual level. The main actors of the network behavior is virtualsex-based cognitive errors and acting in such specific psychological drive to revenge,slander others, and get attention for the pursuit of economic interests. Hence, based onthe comprehensive analysis of the reasons for the proliferation, the followingregulatory measures are included. In the administrative level, the governmentshould establish and improve information disclosure mechanism, enhancing the senseof responsibility of Internet users. In the judicial level, the government shouldimprove the criminal law on regulation of the network rumors. In experience abroadgovernance level, through the analysis of foreign governance network rumors, andcombined with our own experience and fact, we got the following revelation: the firstis improving the laws and regulations, and enhancing maneuverability; the second isencouraging industry self-regulation; the third is strengthening the networkmonitoring. Through the above tripartite efforts, rumors crimes will be in socialcontrols, thus forming the security social atmosphere: not believing rumors, notpassing rumors, and not spreading rumors.
