In human society, since rumor is the existence of the phenomenon, long beforewithout words, in the form of rumors spread by oral in interpersonal interaction, calledas "the oldest of the mass media" by western scholars (1).Age in progress, in thedevelopment of science and technology, the network has been ubiquitous! Expandingthe coverage of the Internet, web-based infinitely malleable, virtual, chronocharacteristics, such as the Internet has woven net "intense", formed a huge informationspace. Web users, however, differences in cultural level, media literacy is uneven, manyirrational, arbitrary speech emerge in endlessly,"Internet rumors" explosive thisemerging things appeared. Complex in the process of the spread of Internet rumors, bemalicious use of circulating, in the online world and the real world caused seriousinfluence.At present, the legal regulation of network rumors are still at the early stage, lackof blank place in dire need of attention. There has been no special statute law of ourcountry current law to regulate Internet rumors, rumors many code of laws are defined,suitable contradiction and punishment too light and other defects. In September2013,the supreme people’s court, the supreme people’s procuratorate on libel and othercriminal cases dealt with the use of information network to explain some issues ofapplicable law to take the lead in regulations on Internet rumors for more clarity. This isa positive development, is also a beneficial attempt. In this paper, according to askquestions, analyze and solve problems the basic train of thought in his writing, withcommunication and legal theory, the main academic and law on the Internet rumors ofqualitative analysis, and combining with the characteristics of typical case analysis ofthe spread of Internet rumors, mechanism and effect, and the legal status of China’sInternet rumors make analysis and evaluation, puts forward the Suggestions of how toimprove the legal regulation.In this paper, besides introduction and conclusion mainly is divided into five parts.The introduction part: this part from several aspects, including the paper selectedtopic background, the research of academic significance and practical significance, theresearch status at home and abroad, and so on.The second part: the author from two aspects of academic and law of Internetrumors qualitative analysis. By comparing the difference of rumors, rumors and lies, compared network rumors and traditional rumors again, to make up for past research onInternet rumors qualitative one-sided and loopholes, it is concluded that the concept ofcomprehensive. At the same time will categories and characteristics of Internet rumorsmade a clearer and comprehensive induction, it vividly presented an overview ofInternet rumors itself.The third part: from the three aspects to show the complexity in the process of thepropagation of Internet rumors and unpredictable.
